Property transfer declaration

A deed of transfer of ownership is a legally binding written agreement between the owners of an apartment building that contains a description of the building and plot and their division. It is the basis on which shares are bought and sold, mortgaged and public charges are levied on them. It also governs, among other things, obligations, the division of certain costs in the building and the weight of votes at house meetings in certain cases.

The statement includes, among other things:

• division of an apartment building into ownership shares (private ownership, common ownership of all, and common ownership of some)

• rights and obligations of the owner of parts of a building, plot, garages and parking spaces

According to law on apartment buildings Owners of apartment buildings are required to have a declaration of transfer of ownership made for the building and have it registered if a satisfactory and clear transfer agreement is not available. You can obtain information about whether a declaration of transfer of ownership has been made for your building from magistrates.

A building official reviews the transfer of ownership declaration before it is registered and confirms that it is in accordance with the approved drawings and is prepared in accordance with Regulation on property transfer declarations.

You send a declaration of transfer of ownership to the building official at the Garðabær Service Portal.
